ABD'de 15 Ekim 2019 tarihinde Bankamıza karşı açılan ceza davasıyla ilgili olarak Bankamız Yönetim Kurulu tarafından davanın uzlaşma yoluyla sonlandırılması için ABD Adalet Bakanlığı Güney New York Bölge Savcılığı (U.S. Southern District of New York) ile Bankamız arasında "Kovuşturmanın Ertelenmesi Anlaşması" (DPA – Deferred Prosecution Agreement) imzalanması kararlaştırılmıştır. Söz konusu uzlaşma anlaşması kapsamında Bankamız herhangi bir cezai suç kabulü yapmadığı gibi, hiçbir adli veya idari para cezası da ödemeyecektir. Uzman bir kuruluş tarafından düzenlenecek uyum raporunun, ABD Hazine Bakanlığı Yabancı Varlıklar Kontrol Ofisine (OFAC) ve bir nüshasının ABD Güney New York Bölge Başsavcılık Ofisine teslim edilmesinin ardından; Halkbank ve ABD Güney New York Bölge Başsavcılık Ofisi, davanın düşürülmesine dair müşterek bir yazıyı ABD Güney New York Bölge Mahkemesine sunacaktır. Mahkemenin onayıyla birlikte, ABD'de Bankamızla ilgili yaklaşık 9 yıldır devam eden ceza davası süreci sonlanmış olacaktır. Bununla birlikte OFAC, Halkbank'a ilişkin idari süreçleri başka bir aksiyon almaksızın kapattığını tarafımıza bildirmiştir. Bu gelişmeyle birlikte Bankamızın yurt dışı kaynak temin olanaklarının, muhabir ağının ve uluslararası piyasalara erişiminin genişlemesi ile mali bünyesinin olumlu yönde etkilenmesi öngörülmektedir. Ülkemiz ekonomisine 88 yıldır hizmet sunan Bankamız, faaliyetlerini geçmişte olduğu gibi bugün ve gelecekte de tüm ulusal ve uluslararası düzenlemelere uygun, güçlü, güvenilir ve kesintisiz bir şekilde sürdürecek olup hem bankacılık sektörünün hem de ülke ekonomisinin büyümesine katkı sağlamaya devam edecektir. Concerning the criminal charges brought against our Bank on October 15, 2019 in the U.S. it was approved by our Bank's Board of Directors that a Deferred Prosecution Agreement ("DPA") in our Bank's favor be signed with the U.S. Justice Department's U.S. Attorney's Office for the Southern District of New York in order to conclude the case by means of settlement. Within the scope of that settlement agreement our Bank will not be admitting to any criminal wrongdoing, nor will any judicial or administrative fines be paid. Upon the submission of a compliance report which will be drawn up by an expert firm to the U.S. Treasury Department's Office of Foreign Assets Control (OFAC), with a copy to be provided to the U.S. Attorney's Office for the Southern District of New York, Halkbank and the U.S. Attorney's Office will file a joint letter of dismissal to the U.S. District Court for the Southern District of New York. Upon the Court's approval, the criminal case process ongoing with regard to our Bank for around 9 years in the United States will have been completely ended. OFAC also informed our Bank that it was closing its administrative processes of Halkbank without taking further action. This development is expected to positively impact our Bank's financial structure thanks to the expansion of our Bank's access to overseas resources, correspondent banking network and international markets. Serving our country's economy for 88 years, our Bank will maintain its activities in compliance with all local and international regulations and in a robust, trustworthy and seamless manner in the future just like it has done so in the past, and will continue to contribute to the growth of both the banking sector and our country's economy.
